REFINANCE THE EARLY PART OF THE YEAR WITH A COMPANY THAT GAVE US A ADJUSTABLE RATE THAN WAS SOLD TO ANOTHER COMPANY IN A MONTH TIME SO I CONTACTED THIS COMPANY TRYING TO GET A FIX RATE. THAN MY INCOME CHANGE AND I TRIED TO CONTACT THEM TO LET THEM KNOW THAT MY INCOME CHANGE AND REALLY NEED TO GET THE MORTGAGE DOWN TO AMOUNT WE COULD AFFORD WITH NO LUCK. HOURS AT WORK CHANGE WAS NOT MAKING THE MONEY WE WERE MAKING WHEN WE REFINANCE IN THE EARLY PART OF THE YEAR. ONCE WE SAW THAT WE WERE GETTING BEHIND IN THE PAYMENT I CONTACT THE MORTGAGE COMPANY ONLY TO BE TOLD THAT WE NEEDED TO PAY 2500 DOWN AND THEY COULD TACK ON THE REMAINING BALANCE WITH THE MORTGAGE PAYMENT EACH MONTH THAT WOULD INCREASE OUR PAYMENT WELL OVER 1500 A MONTH AND WE DID NOT HAVE THAT KIND OF MONEY TO PAY EACH MONTH BEING THAT MY HOURS WAS CUT AT WORK.

I became disabled in September of 2006. My family financially supported me through to August 2007. Social Security informed me that the only way to get my case exipidited is by when a medical condition becomes life threatening , eviction or foreclosure. Contacted SS & they have told me they have my case and is expediting it. I am to call 01/02/08 for the status. I was served my summons on 12/17/07 with 20 calendar days to respond. My note was sold to the present company America\'s Servicing Co/ aka Foreclosure Summons > HSBC Bank USA I kept them informed of everything that has happen along the way. I received a letter stating my mortgage has gone up from 7.490% to 10.490% begnining 09/01/2007. They filed the Mortgage Foreclosure Complaint with Count 1-Mortgage Foreclosure and Count-II-Re-Establishment of Note. Which has incorrect figures ex. monthly payment amt. , Interest Rate and it states the Plaintiff does not presently have a copy of the note, but is seeking to obtain a copy & will file with the Court when obtained. They state that the reinstatement amount through 1/10/2008 is $6,439.20. This mortgage company has tried to cause to me fail by not informing me that the needed foreclosure notice required for SS expedition would not be sent to me unless I requested it from their Foreclosure Attys. They rudely informed me it was already on the way & the atty\'s informed me they don\'t send anything unless requested from the debtor. No ethics!
