My wife was in work related injury. Then my sister started litigating on another property that I had POA on. To stop her I file for BK 13. BK13. I just dismissed BK13, because BK13 was snatching $1500 a month from us. We can afford the payments but our mortgage company is off. I was in a Bankruptcy 13 converted to a 7, in the midst, Ocwen stated that I wouldn't be eligible for a Repayment Plan but I would be for a Modification~I was behind 3 months, then they recently tacked on the other 4 months, putting me at 7 mos. behind. Debra Spaulding in the Loss mitigation keeps telling me she hasn't heard from their Bankruptcy Dept. and I am to have my Lawyer fax a consent letter to them, giving them permission to move forward with my Mod Review. A man there told me my November payment was Due. and gave me the option to call it in over the phone or to Money gram my payment. Another Lady (Candace) told me NOT to send in any payments, for it will throw the figures off. Recently, in the Bankruptcy Dept (Heather) stated I should not send payments in and to contact my Attorney. My Attorney has fax (as I watched) a consent letter to speak to me directly about any matters concerning my mod. until it is completed.
Ocwen Mortgage is stating the letter has to say specific words. ( I will tell you word for word when your rep calls to assist me), then when the Heather said I am now showing 7 months behind, she said I was up for a review for a default letter to go into collection and then foreclosure. I asked what happened to the Modification? She said we need the consent letter from the Attorney. (which he faxed) It sounds like a game they are playing to move forward with the foreclosure, my attorney is not going to fax that letter they want which has to say, "Consent to propose Mod, and no further court involvement required" the word play to me and my attorney, they need this statement from him providing no legal action from him will be taken and they can move forward with the collection/Foreclosure. My attorney stated to send them a payment certified/wire. An see how they will respond. Ocwen Mortgage has not sent me any Modification notifications/agreement procedures, or anything for the month of November.

I move in at this address, and i just love it. It was a little fixer upper,and still needs help in some parts, a friend of mine knew the family that had this house but they were not living in it, it had been sitting empty for about 3 years, but i didn't go through a realtor. This started back in oct. with 2 deaths in my family within a week apart from each other, so I missed some work and I did catch up by December, then some my utilities became more than my mortgage payments of 740.00 a month, then in first of April, I was in the hospital for a whole week, and another week after that, so 2 weeks, again with out work, I've tried getting a equity loan at my bank here in Dallas, didn't qualify, I tried Citi Financial turned down also, then homebuyers here in Dallas Fort Worth area and they could not take me either, I hope you can help me, my mortgage company is Wilshire out of Oregon, I talk to someone there but they still send me a letter from a collection agency in Houston, Texas. by Mann & Stevens, I do have some cash in my bank account to at least make up 2 or 3 months, I do have till next week to pay that 4 thousand seven hundred dollars, I'm working all week this week and sat to try to make it, I tried to make a payment with Wilshire a few weeks back and they wouldn't take it over the phone
