I purchased my home in July 2006 for $390k and have a 1st mortgage for $312k and a equity line for $40k. As a result of making minimum payments on my 1st, I know owe $321k and have a pre-pay penalty of $10k for a total of $376k owing on the property. I have been told that I could only sell the home now for approx. $370k and would need another $30-40k just to relieve myself of the property. I experienced a financial set=back earlier this year and was on disability and unpaid leave. I no longer can afford the payments on the home.

We are now down to one income. My husband is main bread winner, but I lost my job about year and a half ago. I started falling behind in mortgage by 2 - 3 months. I call my mortgage company and they did a loan modification, but my mortgage payment went up even higher, still unable to come up with payment. At one point, my mom got sick and I told them at this point I had to stay at home with my mother and there response was we can't help you need to get a job. I took a 500.oo paycut because of the California budget cut! this is why I got behind, before this I had 3 years of on time payment! my % rate is 8.5, if I could modify to current market rate I could afford my payments! Countrywide does't seem to want to help me qualify for loan modification its like they were trying to disqualify me! as of today January I an 4 months behind I have the money for 1 payment, they want to give me another mortgage, that would cost me more in 6 months, I know I deserve the help of a loan modification, pls help thank- you
